This section of the British Army's web site covers such matters as summary dealing, courts martial, the Standing Civilian Court and the military criminal justice system. There are links to information on the Armed Forces Act 2006 which will harmonise the arrangements for discipline across all three services and which comes fully into force in October 2009.

Aspals Legal Pages
Aspals Legal Pages is aimed primarily at military and international lawyers involved in court martial defence work in the UK. The principal webmaster is a former Army Legal Services Officer and the site hosts contributions from practising and non-practising lawyers. It includes digests of court martial cases at first instance and appeal, links to relevant legislation and news and articles about military law.

Baha Mousa Public Inquiry
Baha Mousa was an Iraqi civilian who died in Iraq in September 2003 while in the custody of British soldiers. A public inquiry into the circumstances surrounding the death of Baha Mousa and the treatment of other Irqai citizens who were detained with him in Basra was announced by the government in May 2008 and, under the chairmanship of Sir William Gage, formally opened in July 2009. Documents on the site include transcripts of hearings, evidence and press notices. |
Deepcut Review
A review of the circumstances surrounding the deaths of four soldiers at Princess Royal Barracks, Deepcut, between 1995 and 2002 was carried out by Nicholas Blake QC (now Mr Justice Blake). The full text of his report, published 29 March 2006, is available here on TSO's Official Documents web site.

Defence: Boards of Inquiry
Boards of Inquiry (BOI) are 'in-house' investigations by the Ministry of Defence carried out for the purpose of establishing the circumstances surrounding serious accidents and incidents, including the deaths of armed forces personnel. Accessible from this page are the reports of various boards, mostly relating to incidents 2000 onwards, together with a group relating to the Falklands War of 1982. There is also a briefing note explaining the BOI process.

Directorate of Legal Services (RAF)
The Directorate of Legal Services (RAF) provides advice, assistance and instruction within the RAF relating to air force law and legal issues. Information on its web site includes a detailed account of air force law, with particular reference to courts martial, and the full text of the Manual of Air Force Law, volume I.

First-tier Tribunal (War Pensions and Armed Forces Compensation)
The First-tier Tribunal (War Pensions and Armed Forces Compensation) hears appeals from ex-servicemen or women in England and Wales about the two schemes that provide compensation for injuries in the armed forces - the War Pensions Scheme and the Armed Forces Compensation Scheme. Formerly known as the Pensions Appeal Tribunal, it has since 3 November 2008 formed the War Pensions and Armed Forces Compensation Chamber of the First-tier Tribunal. The site provides information on the appeal process, leaflets, forms, and procedural rules.

Ministry of Defence Byelaws
This is a collection of byelaws regulating the use of land being used for military purposes. These can be viewed by selecting a geographical area from a map or from a list. The site covers the whole of the UK and includes (as well as current byelaws) lapsed, revoked and proposed new byelaws.

Office of the Judge Advocate General
The Judge Advocate General is the presiding judge in the military criminal jurisdiction, and the Office of the Judge Advocate General is responsible for courts martial - trials of service men and women for serious criminal offences. This section of Her Majesty's Courts Service's web site includes the various official guides to court martial practice, procedure and sentencing. |
Pensions Appeal Tribunals - Scotland
Pensions Appeal Tribunals Scotland hear appeals from ex-servicemen and women in Scotland who have had their claims for a war pension rejected by the Secretary of State for Defence. Besides information on the appeal process, the site has a set of Medical Appendices which provide basic information on a range of medical conditions.

Service Complaints Commissioner
The post of Service Complaints Commissioner for the Armed Forces was created by the Armed Forces Act 2006, following recommendations made by Nicholas Blake QC in the Deepcut Review. The site has information on the role of the Commissioner, details of the complaint procedure, a downloadable complaint form, and annual reports.
